Go Birdz Car Rental NZ Rental Terms for travel between 01-Jan-2008 and 30-Sep-2010
Definitions
‘This agreement’ means the Rental Agreement and these Terms and Conditions. ‘Customer’ means the person or persons nominated as the hirer and any person whose credit card is presented for payment of the Customer’s charges.
All Inclusive hire charges
All inclusive hire charges include New Zealand’s Goods and Services Tax (GST) and daily insurance. There is a charge for additional equipment child seat etc.
Driver’s licence
Hirer and driver must produce a valid driver’s licence. New Zealand recognises driver’s licences issued by your own country, If the licence is not in English format, an International drivers license is also required. If you are a member of an Automobile Association bring your membership card with you and gain additional privileges and information on travel throughout New Zealand.
Payment terms
Car rentals are calculated on a 24 – hour basis. Late pick up or early return of vehicle does not entitle the hirer to any refund of the unused portion of the rental. Go Birdz allows a grace period of 59 mins before they charge late return charges. 1 hour late – one third of daily rate. 2 hours late, two thirds of daily rate, 3 hours late, one full date rate will apply.
Deposit
An initial non refundable deposit will be secured at the time of reservation confirmation. Accepted credit cards include: Visa and Mastercard only.
Delivery and return of the Vehicle
The Customer acknowledges having received the Vehicle in a clean condition, with a full tank of fuel.
Security Deposit
Go Birdz requires a credit card imprint for the insurance excess amount. This is not withdrawn from your account and is held only as an authorization. This is only auctioned in the case of an accident or damage occurring. Where a credit card is not available, Go Birdz Ltd requires a cash bond payable upon collection of the vehicle. This will be returned upon the checking of the vehicle and its condition when handed back to a Go Birdz representative.
Cancellation Policy
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges apply:
Cancellation 27 days + prior to pick-up date - No further charges
Cancellation 13 to 27 days prior to pick-up date - 20% of Gross Rental, (minimum NZ$250)
Cancellation less than 13 days prior to pick-up date - 50% of Gross Rental
No-show - 100% of Gross Rental
There is no refund for late pick up or early return of vehicle.
Credit Cards
The credit card holder will be jointly and severally liable as a customer. Accepted credit cards are Visa, MasterCard and American Express. A non-refundable 2% surcharge will apply to all credit card transactions. When payment is made by credit card, the customer agrees that:
a) Go Birdz is irrevocably authorized to complete any documentation and to take any other action to recover from the Customer’s credit card issuer all amounts due by the Customer pursuant to this agreement, including but not limiting to any amounts due in respect of damage to the Vehicle or to property of a third party and all additional charges as they are incurred including all parking and traffic infringement penalties, road toll fines and associated administration costs. Go Birdz may process credit card charges pertaining to the rental after the hire period.
Other queries
No pets allowed.
No smoking inside cars is allowed.
Child seat can be added.
All Vehicles can only be driven on sealed/bitumen roads
Vehicles are not permitted on the following roads:
Ninety mile beach (Northland)
Skippers rd (Queenstown)
North of Colville township (Coromandel peninsula)
Vehicles are not permitted on ski roads.
Go Birdz reserves the right at its sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.
Offices closed
Offices closed on Christmas Day, New Years Day and Good Friday.
Information disclaimer
On very rare occasions, a rate may be quoted incorrectly. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information up to date, but we cannot guarantee this and retain the right to update or change the information published at any time.
Vehicle Capacity and fitness to drive
You must only carry the amount of passenger that the vehicle you rent is legally registered to carry, and if you do not your insurance may be invalidated. Luggage capacity where shown is an indication only and we will not be responsible if you are unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. Go Birdz can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
Go Birdz Car NZ Insurance
Our rates quoted include insurance with a liability of NZ$1,500 and optional bond waiver to reduce excess to nil is available for NZ$20 per day.
Vehicle Damage exclusions
Tyre wheel and rim damage are not covered under any policy
Vehicle Damage – excess reductions
The customer understands that:
a) The Vehicle is insured for third party Vehicle and property damage.
b) The Customer will have to pay excess in respect of any damage incurred whilst in the customers possession.
c) The excess may be reduced by taking out excess reduction options.
d) Insurance excess applies in respect of each claim not rental period, the excess is applicable regardless of whose fault and must be paid at the time the accident report is completed, not at the completion of the rental. The excess will only be refunded if Go Birdz are successful in recovering the cost of the damages from the third party. Please note that third party claims can take many months to resolve. Damage includes any and all damage to third party property, damage to the rented vehicle including windscreens, tyres, towing and recovery costs, theft, fire break in or vandalism. This also includes the cost of the daily rental for the period the vehicle is off the road.
One way Fees
One way fee between Auckland and the Bay of Islands incur a charge of NZ$220
Vehicle Description
The owner will let and the hirer will take on the motor vehicle described in the Schedule ("the vehicle") on the terms set out in this agreement.
Insurance Exclusions:
a) Water submersion or salt-water damage is not covered by any insurance option.
b) Personal belongings are not covered. We recommend the hirer does not leave valuables in the vehicle and should take out personal insurance.
c) All Excess Reduction is void if the terms of the Rental Agreement are breached. The hirer will be responsible for the total cost of any damage. This will also include any damage caused by wilful conduct (e.g. sitting or standing on the bonnet or roof of the vehicle) and driving under the influence of alcohol or drugs.
d) The vehicle is wilfully or recklessly damaged by the hirer or any other person named in the Schedule to this agreement or driving the vehicle under the authorisation of the hirer, or is lost as the result of wilful or reckless behaviour of the hirer or any such person. (Note: Punctures, damage to tyres, rims, burning out a clutch and any damage arising from using the vehicle to propel any other vehicle are regarded as wilful or reckless damage).
e) None of the insurance options cover the incorrect use of fuel (fuel being diesel or petrol). The hirer will be responsible for any associated costs.
f) The hirer will be responsible for the cost to retrieve or recover a vehicle, which has become bogged, regardless of the insurance options taken.
g) If the vehicle is operated in any race, speed test, rally or contest; insurance is void.
h) The hirer is not a body corporate or department of State and the vehicle is driven by any person not named in the Schedule to this agreement.
i) The vehicle is driven by any person who at the time when he/she drives the vehicle is disqualified from holding or has never held a driver’s license appropriate for that vehicle.
j) The vehicle is operated on any unsealed road or beach and any of the following roads:
Ninety Mile Beach (Northland), Roads North of Colville Township, Ball Hutt Road (Mt Cook), Skippers Road (Queenstown).
k) The vehicle is operated outside of the hire or any agreed extension of that term.
l) It is agreed between the owner and the hirer that section 11 of the Insurance Law Reform Act 1977 shall apply with respect to the above exclusions as if this clause constitutes a contract of insurance.
m) The hirer acknowledges that he/she shall be liable in respect of the first of the damage or loss referred to in the insurance cover specified in this clause to the amount of the excess shown in the Schedule. This applies to damage or loss resulting from the theft or conversion or attempted theft or conversion of the vehicle.
n) New Zealand legislation provides limited coverage for personal injury. We strongly recommend that you have personal travel insurance while travelling
o) All insurance options exclude cost to replace keys, which have become lost, or retrieval of keys, which have been locked in a vehicle.
p) In the event of an accident occurring and an Exchange Vehicle is not available, Go Birdz will not be liable for any resulting accommodation or living expenses that are in incurred.
q)Tyre and Windscreen Damage – Where the hire has a nil excess up to one windscreen and two tyres will be covered for accidental damage. Should these amounts be exceeded the cost to repair or replace the items will not be covered and will be the responsibility of the hirer.
r) Overhead and underbody damage to the vehicle.
Any damage arising from misjudgement of dimensions
Release and Indemnity of Go Birdz
The customers releases Go Birdz, its employees and agents from any liability to the Customer, (regardless of who is at fault), for any loss or damage incurred by the Customer by reason of rental possession or use of the Vehicle. The Customers hereby indemnifies and shall keep indemnified Go Birdz, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of the Customers use and/or possession of the Vehicle.
Procedures in case of an accident
If the Customer is involved in a motor vehicle accident whilst on hire, the following procedure should be followed: - At the accident scene the Customer Must
a) Obtain the addresses of Third Parties and Witnesses.
b) Report the accident to the Police regardless of any estimated damage cost.
c) Not accept blame or insist the other party is at fault.
d) If at all possible photograph damage to all vehicles and take all registration numbers.
Phone Go Birdz with the accident’s details within 24 hours.
Additional Hire Costs
An hourly cleaning charge of NZ$75 per hour will be charged for any vehicle returned excessively dirty inside or out, in the sole opinion of the owner.
• A processing fee of NZ$45 (per fine) will be charged for any unpaid parking and speeding fines incurred during the rental period. This is regardless of whether knowledge of these is known.
• A refuelling fee of NZ$30 should fuel not be refilled upon return of vehicle
After Hours Surcharge
Our Normal pick-up and drop of time is between 08:30am – 04:30pm. Any pick ups or drop offs that fall outside this time will incur an after hour surcharge of $75.00.
Travel Insurance
We strongly recommend that clients ensure they take out the highest level of Travel Insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking. Go Birdz does not accept any liability for personal injuries sustained during rental.
Child Seats
All child seats are subject to availability. It is the client’s responsibility to check child seat fittings. Go Birdz Rental Limited accepts no responsibility what so ever for child seats that are incorrectly fitted.
Breakdowns
AA Nationwide 24 hour freecall helpline are there should you require assistance. If you incur any minor repair bills we will give you a refund (up to NZ$100). Just produce receipts. If major repairs are needed, protect yourself by getting us to authorise it first.) The availability of an Exchange Vehicle is not guaranteed; provision is subject to availability, client location, accident liability and remaining hire duration. Hirer charges may be incurred (see below) • If an Exchange Vehicle is required as a result of an accident, the hirer is responsible for making their own way to the Go Birdz branch or pickup location •Go Birdz may offer the hirer the option of paying an ‘Exchange Vehicle Relocation Fee’ to send a driver or tow-truck to deliver the exchange vehicle to the hirer’s location. This charge applies irrespective of any excess reduction taken. In the event of an accident occurring and an Exchange Vehicle is not available, Go Birdz will not be liable for any resulting accommodation or living expenses that are in incurred.
Problems encountered with the vehicle or equipment must be reported to Go Birdz as soon as practicable. This gives Go Birdz the opportunity to rectify the problem within the rental period. Failure to do so will compromise any claim that may eventuate after the hire is finished. In all cases the responsibility of Go Birdz is limited to refunding for the time that the vehicle was actually in repair. No alternative accommodation or food items will be paid for during down time. Malfunction of Radio/Cassette/CD players, are not considered mechanical breakdowns and downtime will not be paid for these items.
With reference to the free bicycle hire Go Birdz shall bear no responsibility for damage, puncture, theft or accident whilst in the hirers possession. The hirer accepts all responsibility and uses at his/her own risk.
Maintenance
The Customer shall take all reasonable steps to properly maintain the Vehicle including daily checks of the oil, water and batteries, and will contact Go Birdz immediately should any Vehicle warning lights indicate any potential malfunction.
Breach of Contract
The owner shall have the right to terminate the hiring and take immediate possession of the vehicle if the hirer fails to comply with any Terms and Conditions of this agreement or if the vehicle is damaged. The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the hirer under this agreement or otherwise.
Exchange Rates/Currency Fluctuations
All transactions are conducted in New Zealand dollars. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against your credit card and the amount refunded at the expiration of the rental period. Go Birdz is not liable for such variations.
Laws
This agreement is governed by the laws of New Zealand.
Warranties
The customer warrants that all the information supplied to Go Birdz is connection with this agreement is true.
Entire Agreement
This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the matter of this Agreement.

Liability

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

On the morning of your pick up please call our freephone number to reconfirm your pick up time with us. Please be ready to meet us at Motel / Hotel reception.

We will quickly get to you or may then instruct you to take a taxi to our depot and we will refund fare upon producing your receipt.

Kerikeri Airport Pick ups
Please provide us with your Airline flight arrival details. This is very important to ensure we have your correct arrival details.
As you enter the arrivals area at Kerikeri Airport we will meet you and will have a sign with your name on it. If you do not see us there or you have been delayed please telephone us from the airport on any of the numbers provided in your booking confirmation. We will quickly get to you or may then instruct you to take a taxi to our depot and we will refund fare upon producing your receipt.
